While accidents are, unfortunately, commonplace anywhere you do that does nothing to take away from the fact that someone has been inconvenienced or placed at a disadvantage through no fault of their own. The word ‘accident’ does absolutely nothing you waylay the confusion and the hurt that a victim can experience. They didn’t mean to do it? That’s nice but it does not begin to cover you for damages both physical and emotional that you have suffered at the hand of someone who was negligent. Personal injury cases can be filed through one of three ways: a formal lawsuit or an informal settlement.

There is also a middle ground between the two called mediation and arbitration. A formal lawsuit when a civil complaint is filed by one person against another. Attorneys represent both parties involved and attempt to reach a formal settlement which is the put in the form of a legally binding document. An informal settlement is when negotiations take place and a settlement is reached with the help of attorneys but no formal suit is filed. In cases of arbitration, both parties present their case to an unbiased third party who makes a judgment on what the outcome of the situation will be.
