A spokesman from within the North Charleston Police said that when they arrived at the crossing that lies between Gaynor Street and Railroad Avenue, they found a man with a head wound lying on the ground in between both sets of railroad tracks. South Carolina Pedestrian Accidents

We would like to offer our sympathies to the man who was injured in this accident. We wish him a full and speedy recovery.

One of the most challenging parts of any type of car accident is determining who is liable. In most pedestrian-involved accidents the assumption is that the driver of the car was the negligent party. This is not always the case. Pedestrians do have the right-of-way over vehicles in certain instances, such as when they are in a marked or unmarked crosswalk, but they do not have the right-of-way over vehicles anytime they are in the road. Pedestrians must yield the right-of-way to vehicles when crossing outside of a marked crosswalk or an unmarked crosswalk at an intersection. If you have been involved in an accident with a pedestrian, do not automatically assume that you are to blame. You need the services of an experienced accident attorney to go over the facts of your case and determine liability.
