North Charleston, SC (October 21, 2018) – Shortly after 7:00 PM North Charleston Police responded to an accident involving a car striking a pedestrian at a railroad crossing on East Montague Avenue.
A spokesman from within the North Charleston Police said that when they arrived at the crossing that lies between Gaynor Street and Railroad Avenue, they found a man with a head wound lying on the ground in between both sets of railroad tracks. Officials say so far it appears as though the man was attempting to cross the roadway illegally when he was hit by a car traveling west on East Montague Avenue. The car that was involved in the accident did stop by the railroad crossing and wait for the authorities to arrive.
Emergency Medical Services took the man to a nearby hospital to have his injuries treated. There is no word on his identity or his condition at this time.
South Carolina Pedestrian Accidents
We would like to offer our sympathies to the man who was injured in this accident. We wish him a full and speedy recovery.
One of the most challenging parts of any type of car accident is determining who is liable. In most pedestrian-involved accidents the assumption is that the driver of the car was the negligent party. This is not always the case. Pedestrians do have the right-of-way over vehicles in certain instances, such as when they are in a marked or unmarked crosswalk, but they do not have the right-of-way over vehicles anytime they are in the road. Pedestrians must yield the right-of-way to vehicles when crossing outside of a marked crosswalk or an unmarked crosswalk at an intersection. If you have been involved in an accident with a pedestrian, do not automatically assume that you are to blame. You need the services of an experienced accident attorney to go over the facts of your case and determine liability.
Fortunately, you have a legal advocate on your side.
